Tuesday I had a meeting in Baltimore, MD and the day was beautiful, however on my return home we had an unexpected rain shower.  As I was driving I thought well we can use the rain my lawn really needs it.  Though as I approached an accident ahead I found the rain I had just welcomed may have played a role in taking a life. 

I came upon a motorcycle accident and the state police had just arrived on the scene.  It appears a cycler lost control of their bike and had laid it down.  Several cars were pulled off to the side maybe they were involved, maybe it was their fault this person was dead?

I had a bird’s eye view of accident scene from the people weeping to the trooper covering the body with the blanket while they waited for the EMT's arrived.  Being an agent I wondered did this person have life insurance.  Is this person married, have children, a home, is he the bread winner of the family?  Does this person have enough money to pay for their own burial?

I can tell you it’s really very upsetting to see a friend or customer go through one of these horrible events. Many times the spouse is left trying to pay the bills and they are unable to keep everything afloat.  Losing it all should not be an option.

 We try to talk to everyone on the importance of life insurance.  If you owe money, and have a family you at least need a term policy.  It’s your duty to your family to see that they are able to maintain the quality of life that you were able to provide while you were here.  Sorry not trying to tell you how to live your life but we see a lot of people end up in this situation.

For Maryland Condo Owners, Misfortune Just Got More Expensive

Effective June 1, Maryland condominium owners may have to pay up to $5,000 if a fire or other hazard causes damage within their own unit.

Equally important, if the proper disclosures about a new insurance law are not given to a prospective buyer, the real estate sales contract is not enforceable.

A brief bit of background is important. Last year, the Maryland Court of Appeals (the highest court in the state) ruled that condo associations are not required to repair or replace property inside owners' units if it is damaged. For years, many condominium associations obtained what is known as a "single-entity" insurance coverage. The "master policy" would pay the association to repair and replace certain damage -- both in the common elements as well as within a unit itself, subject to any deductible spelled out in the policy.

When the Maryland court rejected this approach, basically holding that unit owners had to pay to repair their own units, this caused considerable consternation among property insurers, condominium managers and boards of directors, and owners of individual units about what kind of coverage should be obtained.

But the Maryland legislature acted, overturning the Court of Appeals case and requiring condo associations to repair property inside a unit and buy insurance that covers that obligation.

Unit owners also have certain duties. If the cause of any damage or destruction to a condominium originates from the unit -- whether or not the unit owner is negligent -- the owner of that unit is obligated to pay the association's deductible, up to $5,000. So, if a fire starts in your unit and damages the building, you pay the deductible.

A deductible is an insurance concept. If you want complete and total coverage for a loss, your premium will be high. However, if you agree to pay a certain portion of the damage yourself, the premium will decrease proportionately. A typical condominium association deductible can be $5,000 or higher.

Before the Maryland appeals court case, the deductible issue caused serious financial problems for associations. If a unit had a plumbing leak and the damage caused was below the deductible threshold, in many cases the association had to bear the cost. The law in Maryland -- as it is in the District, Virginia and many states -- was that unless the governing documents stated otherwise, the deductible was a common expense. This means that all unit owners had to absorb the loss.

The new Maryland law now makes it clear that if the cause of the damage comes from within the unit, that unit owner may need to pay up to $5,000 to the association.

What does this mean for Maryland condominium unit owners? Simply stated, you should have your own insurance policy that will cover the deductible. This is known as an HO-6 policy and is something that all condo owners -- regardless of whether they live in Maryland -- should obtain.

The master policy does not provide all-inclusive coverage. It will pick up the cost to repair your walls or floor, but you are on your own with any personal belongings. And if your apartment is flooded, it's not just your valuable carpet but also your 50-inch plasma TV that could be ruined. Additionally, most master policies exclude what is known as "betterments." If you have the floors installed by the developer in your unit, coverage will probably be available if they are damaged. But if you or a previous owner installed parquet flooring, this is a betterment and will not be covered under most master policies.

Here is where the HO-6 policy comes into play. This will cover your personal losses and should supplement what the master policy does not cover, such as theft, vandalism and personal liability.

The new law now requires potential condominium unit buyers to be put on notice of their responsibility for the master policy deductible. If this notice is not given, the buyer has the absolute right to walk away from the contract. The Greater Capital Area Association of Realtors has just amended its form "Condominium Resale Addendum for Maryland" (Form 1328), which all sellers must give to their buyers no later than 15 days prior to settlement. What happens if the wrong form is used? Simply put, the contract is not legally enforceable.

To put even more teeth into the new law, condominium associations must, on an annual basis, advise all unit owners in writing about their responsibility for the master policy deductible, as well as the amount of the deductible.

This is new law in Maryland, and only time will tell how it will be implemented and interpreted.

However, accidents happen. All condominium owners -- especially in Maryland -- must make absolutely sure they are adequately covered by their own H0-6 policy, and that the coverage includes the $5,000 deductible the new law imposes on them.

Allstate provides tips for parents to talk to teens about safe driving

With High Schools getting set to close and summer vacations planned, the bright sunny days of summer often can create a false sense of security for teen drivers.  Yet summer has a dark side for many teens, as statistics show the summer months are the worst for teen automobile fatalities¹.  Automobile crashes are the number one killer of teenagers in the U.S. with nearly 6,000 teens killed every year² and more than 300,000 injured³.  This tragedy is compounded by the fact that many crashes are preventable.  Driver error, speeding and distractions are the main causes of teen crashes,⁴ and seemingly simple activities such as switching radio stations or interacting with friends can significantly impair a teen’s ability to react quickly to changing traffic conditions.

The summer months are when young drivers are at most risk, and it’s vital for teens and their parents to be aware of the dangers. Allstate is committed to promoting safe driving and our hope is that parents will engage teenagers in discussion and underscore the importance of safe and responsible driving.

Parents need to play a large role in developing their teen’s safe driving behaviors.  According to The Allstate Foundation, although parents acknowledge that they must play a significant role in preparing their teens to drive, many delay safe driving conversations with their teens until shortly before licensure.  Parents also understand they are role models on the road, yet their driving behaviors send the wrong message.  For example, 71 percent admit to talking on a cell phone while driving with their teens, and 26 percent say they have broken the law with their teens in the car.⁵

Allstate provides the following tips for parents to help start a conversation with teens about smart driving:

·         Make your talks a dialog about driving. Remember: teens are excited about driving itself – it’s a fun topic for them. So don’t turn your talks into lectures; instead, make them open dialogs that show you understand the positive side of getting behind the wheel, and let your teens share their views and experiences at the same time.

·         Speak to their desire to be smart. Being a “safe driver” is not something teens aspire to become. Smart driving, on the other hand, combines skill and safety, and is something that teens find especially aspirational.

·         Empower your teen. Being a passenger in another teen's car can put your teen at risk. Peer pressure among teens can be both positive and negative. Make sure your teen knows it's okay to say something if they are uncomfortable while riding with a friend.

·         Be Parental. Express Your Authority. Your teens want to know your values and expect you to provide structure for them. They need you to be a parent, not another friend. Consider using a Parent Teen Driving Agreement to provide guidelines that you require they follow. And, consistently enforce your guidelines. If your teen violates your guidelines, deliver on consequences!  Though taking away the driving privilege for a period of time might not be convenient for you, it might end up saving your teen’s life.

Teen Road Realities:

• A majority of teens admit to risky driving behaviors6
• Fifty-six percent make and answer phone calls while driving7
• Fifty-five percent exceed the speed limit by more than 10 mph8
• The area of the human brain that controls multitasking, impulse control and the ability to envision consequences – areas crucial for driving – is still developing well into an individual’s 20s9
• Talking on a cell phone increases the likelihood of an accident by four times and slows the average person’s reaction time to that of a 70-year-old10

As some local teens attended their prom last weekend, and others anxiously look forward to upcoming high school proms and graduation celebrations, parents are equally excited, but perhaps a little concerned, hoping students celebrate safely and responsibly. What should be a memorable time for students could easily be remembered for all the wrong reasons.

Unfortunately, motor vehicle accidents remain the leading cause of death among 15-to-20-year-olds – claiming nearly 6,000 young lives each year.  The Allstate Foundation’s comprehensive study, “Chronic: a Report on the State of Teen Driving”, includes an in-depth look at teen attitudes on driving and suggests reasons why young drivers become involved in motor vehicle accidents.

Among the Chronic Report’s findings:

• More than half (56%) make and answer phone calls while driving.
• 13% percent (an estimated 1.6 million teens) said they drive while reading or writing text messages.
• 47% percent said passengers sometimes distract them.
• 64% percent admit they speed up to go through a yellow light.
• Nearly 70 % of teens said they’ve felt unsafe when someone else was driving but less than half (45%) would speak up.

With all the excitement, it’s easy for young drivers to lose focus on safety, but it’s their responsibility to eliminate distractions and look out for themselves, their friends and others on the road.”

So what can parents do to help prepare their teens for the prom and other events while keeping a focus on safety?  Allstate Insurance recommends the following tips:

Be clear about the dangers of drinking and driving: Driving under the influence is illegal and unacceptable.  Many statistics can illustrate the dangers of drinking and driving, but make it clear to your teen that making it a safe evening for all is top priority.

Establish an SOS: Transportation plans can easily change on the spot and teens may find themselves in potentially dangerous situations.  Make sure your teen knows it’s OK to not take a ride with a driver whose behavior causes concern.  Teens should be able to call parents or a responsible adult for a safe ride.  

Plan an alternate source of transportation: Instead of driving, arrange for a cab or a limousine. 

Limit the number of passengers in your teenager’s car: More passengers create more potential distractions for the driver.

Reduce distractions: Warn your teen about the dangers of driver distractions, including eating, drinking, or using a cell phone while driving.

Buckle up: Teens, more than any group of drivers and passengers, don’t use seatbelts.  In many communities though, it’s the law.

ID Theft Guide

To protect yourself from becoming a victim: 
•  Don't carry a checkbook. Pay by cash or credit card. 
•  Don't carry your Social Security card with you or use your Social Security number as your driver's license number.  
•  Buy a paper shredder. Shred any documents listing your Social Security number and other financial information such as your bank account numbers and credit card numbers. This is the number one way of preventing identity theft.  
 

 
If someone has taken your identity and is cashing your checks or using your credit cards, you should: 
Report the situation immediately to your bank or credit card company. You may not have monetary liability because forgery and/or fraud is involved, but you will want the companies to be aware of the problem, as this is something that could affect your credit. In addition, follow these instructions to fully protect yourself: 
   
  a) Contact all three credit bureaus and issue a fraud alert. Check your credit report six months later and look for items you don't recognize.  
  b) Provide a copy of your driver's license to each agency's fraud unit in order to register an affidavit. 
  c) Contact the proper authorities in writing, via certified receipt request. 
  d) Inform your local police department, Social Security Administration and all creditors with whom you have accounts.

  If a thief steals your identity and begins racking up debt: 
  a) Contact the fraud units of the three credit reporting agencies. Request that your account be flagged and add a victim's statement saying, "MY ID has been used to fraudulently apply for credit. Call me at this number to verify all applications." Find out how long the fraud alert will be posted and how to extend it if you need to. Check your credit report and look for items you don't recognize. 
   
  b) Contact your credit card companies and financial institutions to report the fraud. Get new cards, have old accounts closed with a memo stating that the account has been closed at the customer's request. Follow up in writing. 
   
  c) Call the police and get the crime on record, then get a copy of the police report. Keep a log of all conversations including date, name, phone number and the information provided. 
   
  d) Notify the Federal Trade Commission, which keeps a database of identity thefts. Phone: (888) FTC-HELP; Address: FTC, CRC-40, Washington D.C. 20580. 
   
  e) Notify you bank and if necessary, cancel checking and savings accounts and get new account numbers. Request a password that may be used in every transaction. Get a new ATM card, account number and password. Don't use your SS # or birthdate as a password. 
   
  f) Don't pay any bill or part of a bill resulting from identity theft. 

Vehicle theft is the number one property crime in the country - costing Americans approximately $7.6 billion each year. The Insurance Information Institute estimates that auto theft and fraud increases insurance premiums for all drivers by $200 - $300 per year. The cost of a car has no relation to which cars are stolen, as most cars are stolen for the value of their parts. Thieves look for older vehicles that can be easily dismantled for parts, which can be sold easily and quickly. These parts can be worth 2 to 3 times more than the value of the vehicle. According to the National Insurance Crime Bureau, popular cars for thieves to steal are the Toyota Camry, Nissan Sentra, and Honda Accord and Civic. Also according to the National Insurance Crime Bureau, 62% of stolen vehicles are eventually found, with varying levels of damage. To safeguard vehicles against criminals, the most important step that consumers can take against vehicle theft is to have the right protection, keeping in mind that state-mandated minimum insurance coverage typically does not cover vehicle theft unless the consumer has included comprehensive coverage on the policy, in addition to collision and liability. To reduce the likelihood of becoming a victim of a crime involving your vehicle, the National Insurance Crime Bureau (NICB) recommends a “layered approach” to vehicle theft protection, including: Common Sense - Always lock your vehicle, close all windows and the sun roof, and take your keys with you. One out of every five vehicles stolen had the keys in it, and almost half were left unlocked. Warning Devices - Use a visible or audible device in your car such as alarms, steering wheel locks or VIN etching, so thieves will know your vehicle is protected. Immobilizing Devices - Smart keys, fuse cut-offs and kill switches prevent thieves from bypassing your ignition and hot-wiring your vehicle. Tracking Devices - The final layer of protection is a tracking device which emits a signal to police or monitoring station when the vehicle is stolen. These are very effective in helping authorities recover stolen vehicles.

Most home burglaries happen in broad daylight, during the middle of the day, when thieves know no one is home. Often, thieves will case certain neighborhoods, certain locations, to verify the time and day when people are gone -- when they leave home to go to work and when they return home from work. Experts say having a dog is not enough. Burglars carry treats in their pockets to buy the dogs’ loyalty. But you can prevent your home from being broken into. To protect your property, get state-of-the-art locks, get an alarm system if you can afford one, and make sure you have adequate insurance. Keep an inventory of what you have in your home. If you have something of substantial worth, consider getting it insured separately. Experts say to store valuables in a safe place, make sure to lock all doors and windows, and don’t hide your keys in obvious places outside.

A Taxing Decision: What to Do with Your Refund

Five tips for making the most of your tax return funds

The tax refund splurges of years past are not a reality for most Americans in 2009. Many people are likely wringing their hands over what to do with the money they receive back from Uncle Sam. Their concerns are well-founded: It’s more important than ever to consider the right options for your refund.

It’s also the right time for refund recipients to consider meeting with a financial professional who can help establish financial priorities and goals.

If you have outstanding bills or debts, take care of those matters first. But if you find you have money left over from your tax refund or have the full amount, don’t be scared of your options – be smart in your decisions.

Allstate recommends considering the following options to put your tax refund to work for you:

• Set up an emergency savings fund. Simply essential. The old conventional wisdom advised saving enough money to cover three to six months of unemployment. Many financial professionals now recommend keeping enough money stashed away to cover six months to one year of unemployment.
• Buy life insurance. Many people have only the life insurance plans offered by their employer. But your family needs protection whether you’re working or between jobs. There are two basic types of life insurance: term and permanent.  A financial professional can help you determine the type and amount of protection you may need.
• Contribute to or open an IRA. Yes, the market is unstable. But pulling out of a retirement plan altogether is not the answer. Both the traditional and Roth IRAs are great ways to save for retirement, although each offers different advantages. If you’re employed and have an IRA, continue contributing. If you’ve become unemployed, you might want to do a rollover from your retirement plan to a qualified IRA.
• Purchase a CD. If you don’t need immediate access to your funds, you may benefit from the fixed interest rates available with a Certificate of Deposit. You can buy a CD with a maturity or holding period as short as 30 days or as long as five years.
• Start or add to a college fund. Pay for the present, or save for your child’s education? That’s the agonizing decision faced by many parents considering a 529 College Savings Plan. But what many parents may not know is that the plan portfolio has different investment allocations based on the age of your child.
